Technical Skills in Drafting the Fixed Duration and Unfixed Duration Employment Contract and Legal Procedures for Termination and Calculation of Termination Benefits

Under the Cambodian Labor Law, there are 2 main types of employment contracts: Fixed Duration Contract (FDC) and Unfixed Duration Contract (UDC). Employers need to comply with different procedures when they develop or terminate each type of contract. Following the right procedure is even more important when the employers calculate the termination benefits because the wrong calculation may lead to an unnecessary dispute with the terminated employee.
3E Advisory and Training Co., Ltd—a training and consulting company duly registered with the Ministry of Commerce—specially designed this training course to equip the participants with the technical skills in drafting an FDC and a UDC according to the Labor Law. The procedures for termination and calculation of termination benefits will also be explained in this course.

COURSE CONTENTS
Session 1: What is a Fixed Duration Contract (FDC) and how to develop it?
Session 2: Procedures for termination and calculation of termination benefits for an FDC, which include:
- Last salary
- Payment in lieu of annual leave
- Prior notice compensation
- Severance pay
- Damages
Session 4: Procedures for termination and calculation of termination benefits for a UDC, which include:
- Last salary
- Payment in lieu of annual leave
- Prior notice compensation
- Indemnity
- Compensation
Mr. SOM Chamnan is an Attorney-at-Law. He is also the Advisor to the Ministry of Labor and Vocational Training, where he provides pro bono technical and legal support to the General Directorate of Labor.
Prior to this, Mr. Chamnan was the Manager of the Labor & Compliance Practice Group of Bun & Associates Law Firm; the Legal & Labor Manager of the Garment Manufacturers Association in Cambodia (GMAC); the Executive Director, Legal Advisor, and Labor Law Trainer of the Cambodian Federation of Employers and Business Associations (CAMFEBA); and the Legal Officer of the Arbitration Council Foundation.
Mr. Chamnan has very extensive and hands-on practical knowledge and experiences in the area of Labor Law and Industrial Relations as he has been practicing this law for over 10 years through advising, providing training and participating in the drafting of many labor regulations.
Under the Australian Leadership Award, Chamnan pursued his study in Australia and obtained the Master of Commercial Law from the University of Melbourne. He also holds a Bachelor of Law from the Royal University of Law and Economic Sciences and a Bachelor of Philosophy from the Royal University of Phnom Penh. Besides, he has also attended many international training/internship programmes, inter alia, the International Internship at the International Labor Organization in Geneva as well as the international training in Italy, South Korea, Japan, Thailand, Singapore, Vietnam.
2- Mr. Koy Tepdaravuth, Director of Labor Dispute Department, MLVT
Mr. Koy Tepdaravuth is the Director of Labor Dispute Department of Ministry of Labor and Vocational Training. Having more than 20 years of experiences in the Cambodian Labor Law and industrial relations, Mr. Tepdaravuth is considered as one of a few Labor Law experts in Cambodia.
